What a Texas Standard Possession Order Covers

A Standard Possession Order is a guideline schedule that sets out when each parent has possession of a child. It commonly covers weekends, weekday periods, holidays, school breaks, birthdays, summer possession, exchanges, and transportation. An expanded standard possession order can provide additional parenting time under specified terms.

Parents may agree in advance to different possession periods, but the written order controls when they can’t reach an agreement. The distance between their residences can also affect schedule options and exchange arrangements. The Standard Possession Order is designed primarily for children age three and older, so younger children may require a different analysis.

The guideline schedule isn’t appropriate for every family. A court may consider the child’s age, school routine, relationship with each parent, travel demands, safety concerns, and best interests when deciding whether to order a different arrangement. This is general legal information. The options in a particular case depend on the facts and any existing orders.

Building a Visitation Schedule Around Daily Life

Texas conservatorship describes the legal rights and responsibilities parents have concerning a child. Possession terms are one part of that broader arrangement, but they should clearly state when, where, and how parenting time will occur.

When a Possession & Access Order Needs to Change

A schedule that once worked may become impractical as a child grows, starts school, takes on new activities, or develops different needs. Changes in a parent’s work schedule, residence, travel demands, or ability to complete exchanges may also create a need to revisit the order.

A request to modify a possession order may address regular periods, holidays, transportation, exchange locations, notice requirements, or supervised conditions. The proposed change should connect the practical problem to the child’s circumstances and best interests. Parents may also develop an agreed schedule, but its terms should be clear, workable, and suitable for court approval.

Enforcing Missed or Denied Parenting Time

Repeatedly missed or denied court-ordered periods may call for visitation enforcement rather than an informal schedule adjustment. A motion to enforce generally must identify the relevant terms of the order and the specific dates or occasions when an alleged violation occurred.

Parents should keep the current order and a dated record of attempted exchanges, denied periods, messages, arrival times, and other facts related to compliance. Texas courts have remedies for violations of possession and access orders and may award additional time to compensate for denied periods in qualifying circumstances. The available remedy depends on the order and the evidence.

Child support and visitation are separate legal obligations. A parent shouldn’t assume that withholding support or refusing possession is a lawful response to the other parent’s conduct. We can assess whether the facts support enforcement, modification, or another legal step.

Safety Concerns and Supervised Visitation

Family violence, alleged abuse or neglect, substance-related concerns, a child’s age, or a limited history of contact may affect whether unsupervised parenting time is appropriate. Depending on the circumstances, a court may consider supervised visitation, protective exchange conditions, or other restrictions focused on the child’s best interests.
