What Is a “No-Fault” Divorce?

Texas has established no-fault divorce, which can facilitate the divorce process since establishing fault through evidence is not a requirement. A no-fault divorce is merely based on the fact that your marriage has broken down to the point where there is no hope of a reconciliation.

Texas still maintains fault grounds which can be used in the divorce process. Proving fault can have a bearing on such issues as the division of marital property, child custody, and spousal support.

  • Having lived separate and apart for at least three years
